Condition 8303 now applies to most temporary visas granted after 18 November 2017. This condition allows the Department to cancel the visas of people who act in ways which endanger individuals or sections of the community. Such behaviour includes stalking, harassment and threatening people, but also includes online posting, such as to Facebook, which vilifies groups based on gender, sexuality, religion or ethnicity.
This is a discretionary power, but we can expect the Department to take a hard line against this sort of behaviour and it will be difficult to persuade them not to cancel visas on these grounds.
